Dr. Zach Thomas and podiatry clinic sued after surgeon allegedly fails to remove hardware post foot surgery

PITTSBURGH — A patient and her husband are suing Zach Thomas, D.P.M. and Academy of Podiatry P.C., podiatrist, and podiatry clinic citing alleged loss of consortium and negligence.

Dawn M. Leech and Jeffrey E. Leech, filed a complaint in the  Court of Common Pleas of Allegheny County, Pennsylvania against the defendants alleging that they inadequately performed surgical techniques to treat plaintiff.

According to the complaint, the plaintiffs allege that, between August 12, 2016 and January 18, 2017, Mrs. Leech underwent medial column fusion, resectioning of the gastrocnemius muscle, harvesting of fusion material and grafting to complete the arthrodesis. The surgery was performed by defendant Thomas. She was advised by defendant Thomas and other physicians of the defendant Academy postoperatively, to undergo a series of x-rays and a CT scan in an attempt to understand why she had no relief from pain after the operation. Yet, Thomas could not explain the cause of pain in her left foot. Mrs. Leech sought a second opinion and underwent another surgery for the removal of the hardware and the cannulated screws in the second metatarsal used by defendant Thomas. Mrs. Leech was further advised that additional surgery in all likelihood will be necessary in order to correct the problem that defendant Thomas tried to correct in the first place. The plaintiffs hold Zach Thomas, D.P.M., and Academy of Podiatry, P.C. responsible because the defendants allegedly failed to properly fuse the plaintiff's left mid-foot and remove the hardware in a timely manner after she complained of pain.

The plaintiffs request a trial by jury and seek judgment in their favor and against the defendants for a sum in excess of the jurisdictional limits of the Board of Arbitrators of this court. They are represented by John E. Quinn of Quinn Logue LLC in Pittsburgh.
