PHILADELPHIA – A retired chemist who says he suffered facial injuries and broken ribs at a Philadelphia café will participate in an arbitration hearing related to the disposition of his case.
In May, court records show an arbitration session was scheduled for the instant litigation on March 1, 2019 at the Philadelphia County Court of Common Pleas Arbitration Center, located on JFK Boulevard in Philadelphia.
Walter J. Gozdan of Warminster first filed suit in the Philadelphia County Court of Common Pleas on May 22 versus Mondo Dei Dolci Café, of Philadelphia.
On May 9, 2017, the plaintiff made a first-time visit to a restaurant adjacent to the defendant’s property. In the process, the suit says he traversed the defendant’s parking lot, where he came into contact with uneven and/or significantly-raised sidewalk blocks and/or pavement, thereby suffering bodily and emotional injuries.
Gozdan alleged he suffered multiple facial abrasions and contusions, a right-hand contusion leading to infection, left elbow contusions limiting the use of his left arm, multiple rib contusions with possible fractures, damaged front teeth from falling face-first to the cement ground, anxiety and depression.
The plaintiff claimed the defendants failed to warn its customers of the dangerous condition, failed to notice the uneven, irregular and dangerous sidewalk blocks which caused the plaintiff to fall and failed to remedy same, in addition to other charges.
For negligence, the plaintiff is seeking damages not in excess of $50,000, together with such other relief as the Court may deem just and fair.
The plaintiff is represented by David B. Kline of Ostroff Injury Law, in Plymouth Meeting.
The defendant has not secured legal counsel, according to court records.
