Rental property owner claims unlawful search and seizure by police

ERIE — A Beaver County resident is suing police officers, citing unlawful search and seizure.

Adam Klimkowski filed a complaint on Aug. 24, in the U.S. District Court for the Western District of Pennsylvania, against Harmony Township, Jason Vular, Ronery Sivewright and James Ivancik alleging that the defendants conducted unlawful search and seizure, in violation of his Fourth Amendment rights.

According to the complaint, Adam Klimkowski claims his rental property was entered by defendants, who forcibly removed the doors to the residence without a warrant or permission. 

Plaintiff also claims that the officers allowed a former resident, Vena Finney, to enter the premises, despite her court-ordered eviction from the residence. 

Thereafter, the plaintiff believes that Finney proceeded to vandalize the property and Klimkowski was subjected to illegal, warrantless search of his property and arrest. As a result, Klimkowski claims the incident painted him in a poor and false light to members of his community and otherwise defamed his character. 

The plaintiff holds Harmony Township, Jason Vular, Ronery Sivewright and James Ivancik responsible because the defendants allegedly conspired to deny plaintiff's his constitutional rights by making false statements, unlawful entry to his property and initiating prosecution without probable cause.

The plaintiff requests a trial by jury and seeks judgment for compensatory general damages, with compensatory special damages, punitive damages, and such other relief, including injunctive and/or declaratory relief, as the Court may deem proper.
