Parents claims child was abused at Allegheny Co. daycare center

PITTSBURGH — The parents of a child are suing a daycare center, citing alleged battery and negligence.

S.S. and J.S., individually and on behalf of their minor child, B.S., filed a complaint on Sept. 6, in the Court of Common Pleas of Allegheny County, against Julia Maria Spencer, Jana Spencer and the Glenshaw Presbyterian Church, doing business as Early Learning Center, alleging that the defendants endangered the welfare of an infant child.

According to the complaint, on April 10, 2017, S.S. plaintiffs' five-month-old infant, B.S., was under the care of defendant Julia Spencer at the Glenshaw Presbyterian Church Early Learning Center when the child was allegedly attacked, assaulted and abused, causing bruises on his neck and shoulder. 

Plaintiffs also claim their child underwent numerous tests, including MRIs, CT scans, X-rays and physical examinations after the alleged abuse. 

The plaintiffs hold Julia Maria Spencer, Jana Spencer and the Glenshaw Presbyterian Church Early Learning Center responsible, because the defendants allegedly failed to ensure that the infant children under their care were being safely properly looked after. They allegedly ignored the proper protocol for handling and caring for an infant child and misreported and obstructed the report of child abuse at the daycare, according to court documents.

The plaintiffs request a trial by jury and seek judgment in an amount in excess of the mandatory arbitration limits, exclusive of costs, interest, and punitive damages.
