Woman sues Monsignor McHugh School after tripping on 'uneven' sidewalk

SCRANTON — Carmella Hutchins filed a complaint on Sept. 17, in the Lackawanna County Court of Common Pleas, against Monsignor McHugh School and the Archdiocese of Scranton, claiming she suffered serious injuries after tripping on the sidewalk outside of the school.

According to the complaint, on June 18, 2017, while Carmella Hutchins was walking on the sidewalk when she tripped and fell on an "uneven" portion that she claims was "dangerous and defective."

She allegedly broke her arm and injured her chest, claiming some of her injuries are permanent.

The plaintiff holds Monsignor McHugh School and the Archdiocese of Scranton responsible because the defendants allegedly failed to inspect and make safe the sidewalk for pedestrians and failed to warn and post adequate warning signs.

The plaintiff requests a trial by jury and seeks judgment for damages in excess of $50,000, plus damages for delay as provided by law. She is represented by Gregory K. Schell of Gregory L. Schell, LLC in Swarthmore.
