Philly newspaper publisher looking to satisfy judgment in excess of $17K over advertising dispute

PHILADELPHIA – The parent company and publisher of two of Philadelphia’s major print news publications wants to satisfy a judgment of more than $17,000 regarding advertising placements in those same newspapers from a dental practice.

Philadelphia Media Network (Newspapers), LLC of Philadelphia initially filed suit in the Philadelphia County Court of Common Pleas on March 29 versus Dental Medical Arts, PLLC (doing business as “Dental Health Care Group”), also of Philadelphia.

The plaintiff publishes the Philadelphia Inquirer and Philadelphia Daily News, and the defendant requested advertising space in those publications for given and pre-determined prices, the suit says. From time to time, the defendant received monthly statements of the balance due and owing plaintiff, and accepted the same without objection, the suit says.

Tthe suit said there is presently due and owing by defendant the sum of $15,398.40, which includes all costs of collection and attorney’s fees of $2,566.40 in accordance with the terms of sale, published in the newspapers of general circulation and the rate books, and the defendant received the benefit of services without making restitution to the plaintiff, according to the lawsuit.

For counts of breach of contract and unjust enrichment, the plaintiff was seeking damages of $15,398.40, plus interest at six percent from June 2, 2017 and costs on both counts.

On May 29, for failure to respond to the complaint in the requisite time limit, a default judgment was entered against garnishee PNC Bank for $16,299.51. Due to responses from interrogatories filed, the final judgment amount sought from PNC Bank was updated to $17.729.28, as of July 31.

On Aug. 13, the plaintiff filed paperwork seeking the satisfaction of that same final amount.

The plaintiff is represented by James W. Adelman of Morris & Adelman, in Bala Cynwyd.

The garnishee is represented by Joel B. Gold in Pittsburgh.
