Allentown couple sue Bed, Bath and Beyond for fall at Christmas Tree Shop

ALLENTOWN — An Allentown couple is suing Bed, Bath and Beyond Inc. and its subsidiary, Christmas Tree Shops Inc., retail store owners, citing alleged negligence.

Michelle J. Krajcirik and Paul Krajcirik filed a complaint on Aug. 22 in the Lehigh County Court of Common Pleas against the defendants, alleging they failed to maintain the premises in good and safe condition. The defendants recently removed the case to U.S. District Court for the Eastern District of Pennsylvania.

According to the complaint, the plaintiffs allege that on Nov. 28, 2015 Michelle Krajcirik was shopping at Christmas Tree Shop in Hanover Township when she slipped and fell on an unknown substance on the floor. She sustained injuries to her left knee, wrists, ankle and lower back, and Paul Krajcirik has been deprived of his wife's love, companionship, society and assistance, the lawsuit alleges.

The plaintiffs hold Bed, Bath and Beyond Inc. and its subsidiary Christmas Tree Shops Inc. responsible because the defendants allegedly failed to properly inspect the store premises to discover the dangerous condition, failed to make it safe, and failed to give notice of the existing danger.

The plaintiffs request a trial by jury and seek judgment against defendants in an amount in excess of $50.000, plus interest and costs and such other just and proper relief. They are represented by Daniel Dougherty of Daniel G. Dougherty PC in Whitehall.
