Electrical technician alleges age discrimination by FirstEnergy Nuclear Operating Co.

PITTSBURGH — An electrical technician is suing FirstEnergy Nuclear Operating Co., his employer, citing alleged age discrimination.

Wayne Parker filed a complaint on Sept. 24 in the U.S. District Court for the Western District of Pennsylvania against FirstEnergy Nuclear Operating Co., alleging the employer consistently denies him the training required to advance to the 9.5 highest pay level within the group.

According to the complaint, the plaintiff alleges that between October 2017 and April 2018, he switched positions from a 1/C9.3 Electrical Technician to a 2/C I & C Technician because he had been blocked by the defendant from receiving the training necessary to progress to the highest paid position as a 9.51/C Electrical Technician. 

All technicians in the I & C Technician group receive training to progress to the highest 9.5 pay grade level in that classification. Furthermore, Parker has persistently been questioned by superintendents, supervisors, and training personnel concerning his anticipated retirement date, the suit says. 

The plaintiff holds FirstEnergy Nuclear Operating Co. responsible because the defendant allegedly provides training to significantly younger employees within the group and discriminates against older workers in violation of the federal Age Discrimination in Employment Act.

The plaintiff requests a trial by jury and seeks back pay with prejudgment interest, in amounts to be determined at trial, compensation for past and pecuniary losses, liquidated or punitive damage and such further relief as the court deems necessary and proper. He is represented by Jeffrey Morris of Elliott & Davis PC in Pittsburgh.
