Doctoral student claims she was wrongfully dismissed from Marywood University after sexual misconduct report

SCRANTON — A doctorate student is suing a university, citing alleged breach of contract and negligence.

Sandra Harvey filed a complaint on Sept. 26 in the Lackawanna County Court of Common Pleas against Marywood University, alleging the defendant dismissed her doctorate program, violating the confidentiality agreement allowing her to obtain her doctorate.

According to the complaint, on April 17, 2017, Sandra Harvey was informed by defendant they were recommending her dismissal from the university. 

Plaintiff claims the dismissal is a breach of contract for failure to separate her academic files from the sexual misconduct records she reported against a former academic advisor. 

Despite her appeal, the university, faculty and management were constantly shifting and lacked any stability for her in obtaining her doctorate. As a result, she claims she will be prevented from obtaining her doctorate and suffers great economic loss. 

The plaintiff holds Marywood University responsible because the defendant allegedly failed to properly safeguard plaintiff's academic records, failed to allow her to obtain her doctorate pursuant to the confidentiality agreement, and failed to follow its own policies for dismissal of doctorate student.

The plaintiff requests a trial by jury and respectfully requests the court to grant judgment in her favor. She is represented by Michael Goffer of Law Offices of Goffer & Cimini in Scranton.
