Insurer seeks $74K for water damage

MEDIA — An insurance company, as subrogee of Bracy Construction Inc., is suing Madsen Inc., a subcontractor of plumbing services, alleging unpaid insurance claims.

Pennsylvania National Mutual Casualty Insurance Co. filed a complaint on Oct. 4 in the Court of Common Pleas of Delaware County against Madsen Inc., alleging the subcontractor of plumbing services failed to pay plaintiff.

According to the complaint, the plaintiff alleges that in November 2017, it was learned that pipes in an old system had not been properly capped resulting in water leakage, and the damages required repairs in the amount of $74,489.35. Bracy Construction presented a claim to its insurance carrier, Pennsylvania National Mutual Casualty Insurance Co., which has made payment for the loss and pursues this action in subrogation against the defendant.

The plaintiff holds Madsen Inc. responsible because the defendant allegedly failed to properly remove and cap existing water lines and failed to assure the lines were capped before installing new equipment when it was hired to remove and replace plumbing and heating fixtures. Furthermore, defendant has failed to make payments, it says.

The plaintiff seeks in the amount of $74,489.35, plus costs of suit. They are represented by Thomas Brenner of Caldwell & Kearns in Harrisburg.
