Passenger sues Rose Transit Authority following fall on bus

LANCASTER — A passenger is suing a transit authority, a common carrier owner, citing alleged unpaid benefits.

Ana Ortiz filed a complaint on Aug. 31 in the Lancaster County Court of Common Pleas against South Central Transit Authority, d/b/a Rose Transit Authority, alleging failure to pay uninsured motorist benefits.

According to the complaint, the plaintiff alleges that on Sept. 2, 2016, she was a passenger on defendant's bus when she was caused to fall inside the bus due to the negligent act of an unknown driver. She says she suffered severe and permanent injuries to the upper extremity, shoulder and cervical spine. 

The plaintiff holds South Central Transit Authority, d/b/a Rose Transit Authority, responsible because the defendant allegedly refused to settle, negotiate and consider plaintiff's uninsured motorist claim.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount of not less than $50,000, plus interest and costs. She is represented by Jerry Lyons of Joseph Chaiken & Associates PC in Philadelphia.

The Lancaster County Court of Common Pleas Case No. is 18-7356.
