Company sues over alleged damage to roof caused by T-Mobile cell tower

PHILADELPHIA — A New Jersey limited partnership is suing American Tower Corp. and T-Mobile USA, cellular equipment installers, citing alleged breach of agreement.

Liberty Township Philly LP filed a complaint on Oct. 9 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging they negligently departed from the standard of care in installing certain cellular equipment.

According to the complaint, the plaintiff alleges that in 2009, defendants installed certain cellular equipment on the roof of plaintiff's building. As a result of defendants' negligent installation, the brick facade of the building was severely damaged and plaintiff was caused to suffer economic damages of more than $600,000, the suit says. 

The plaintiff holds American Tower Corp. and T-Mobile USA responsible because the defendants allegedly negligently installed the device on the parapet wall as opposed to freely standing on the roof.

The plaintiff requests a trial by jury and seeks judgment in its favor for all damages, attorney's fees, costs and interest. It is represented by Alan Millstein and Jeffrey Resnick of Sherman, Silverstein, Kohl, Rose & Podolsky PA in Moorestown, New Jersey.

The U.S. District Court for the Eastern District of Pennsylvania Case No. is 2:18-cv-04357-JCJ.
