Class action lawsuit claims Direct Energy made harassing phone calls

PHILADELPHIA — Consumers have filed a class action lawsuit against Direct Energy LP, an energy service provider, citing alleged violation of telephone harassment statutes.

James Everett Shelton and Jon Frey, individually and on behalf of all others similarly situated, filed a complaint on Oct. 9 in the U.S. District Court for the Eastern District of Pennsylvania's Philadelphia Division against Direct Energy LP, alleging the energy service provider violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiffs allege that James Everett Shelton and Jon Frey received telemarketing calls from defendant attempting to convince them to switch energy provider to defendant. As a result of defendant's conduct, plaintiffs were disturbed, annoyed and frustrated, they say. 

The plaintiffs hold Direct Energy LP responsible because the defendant allegedly placed telemarketing calls to plaintiffs' phones without their consent and used an automated telephone dialing system and/or pre-recorded voice message.

The plaintiffs request a trial by jury and seek an order certifying this action as a class action and appointing plaintiffs and their counsel as representatives for an award of $500 for each violation and $1,500 for each willful violation, attorney's fees, costs and such other just and equitable relief. They are represented by Clayton Morrow of Morrow & Artim PC in Pittsburgh and Anthony Paronich of Broderick & Paronich PC in Boston.
