PITTSBURGH — Co-administrators of a deceased man are suing a roofing company, citing alleged negligence that resulted in wrongful death.
Clara Jane Guthrie and Keith Loughner, as co-administrators of the Estate of Adam R. McLaughlin, deceased, filed a complaint in the Court of Common Pleas of Allegheny County against Burns & Scalo Roofing Co. Inc.; Edward Weightman, dba Weightman Contracting Co.; and Oscar Acosta Torres, alleging the defendants failed to exercise reasonable care and/or control of the project by subjecting McLaughlin to physical harm and death.
According to the complaint, on Oct. 25, 2016, on his first day on defendants' project, McLaughlin did not receive safety training even though representatives of defendants were present at the site.
Plaintiffs claim during his arrival at the site, McLaughlin suffered a seizure but was permitted to continue working. As he was asked to bring drinks to the roof, he suffered another seizure while climbing a ladder, at which point he fell and struck the ground, the suit says. As a result, he died due to a blunt force trauma of the head.
The plaintiffs allege the defendants failed to provide adequate and/or any safety instructions to workers on the project and failed to furnish workers a place of employment that was free from recognized hazards that caused death and serious physical harm to McLaughlin.
The plaintiffs request a trial by jury and seek judgment for damages in an amount in excess of arbitration limits, plus interest, costs of suit, and any other relief the court deems appropriate.
