PITTSBURGH — A fraternity member is suing Alpha Epsilon Pi Fraternity Inc., Alpha Epsilon Pi - Alpha Kappa Chapter, and Charles Poe, fraternity organizations and master, citing alleged breach of contract and negligent infliction of emotional distress.

John Doe filed a complaint on Oct. 17 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging they wrongfully suspended plaintiff from the organization.

According to the complaint, the plaintiff alleges that on Sept. 11 he received a letter from AEPi – Alpha Kappa Chapter informing him that his membership privileges were temporarily suspended. The plaintiff holds Alpha Epsilon Pi Fraternity Inc., Alpha Epsilon Pi - Alpha Kappa Chapter and Charles Poe responsible because the defendants allegedly did not follow processes and procedures with respect to the suspension of the plaintiff from the fraternal organization.

The plaintiff requests a trial by jury and seeks damages in an amount to be determined at trial. He further seeks reinstatement to Alpha Epsilon Pi - Alpha Kappa Chapter and removal of any record of his suspension from his records held by the fraternal organization.

He is represented by Kevin Rauch of Summers, Mcdonnell, Hudock, Guthrie & Rauch P.C. in Harrisburg and Andrew Miltenberg, Stuart Bernstein and Kara Gorycki of Nesenoff & Miltenberg LLP in New York.

The U.S. District Court for the Western District of Pennsylvania Case No. is 2:18-cv-01388-MJH.
