PITTSBURGH — An invitee is suing United Cerebral Palsy of Pittsburgh, d/b/a Concepts for Community, a Pennsylvania nonprofit entity, citing alleged premises liability and negligence.
Nikkia Jackson filed a complaint on Oct. 18 in the Court of Common Pleas of Allegheny County against Concepts for Community, alleging it failed to follow applicable safety guidelines and regulations.
According to the complaint, the plaintiff alleges that on April 27, 2017, she was lawfully on the premises of the defendant located at 1700 Hollyrood Road in Pittsburgh. During the course and scope of her employment as a residential care assistant for Community Living and Support Services, plaintiff states that a defective wood plank of the porch/ramp gave way, causing her to fall and sustain various severe and permanent bodily injuries, including pain and suffering, loss of earnings and/or earning power, loss of use of a bodily function, dismemberment, and/or scarring, loss of the enjoyment of her usual duties and activities, and shortening of her life expectancy., the suit says.
The plaintiff holds Concepts for Community responsible because the defendant allegedly allowed the defective porch/ramp to be kept in a dangerous condition for a prolonged period of time, failed to properly inspect and maintain the premises so as to identify defects and prevent potential bodily injuries, and failed to ensure the premises could be traversed.
The plaintiff requests a trial by jury and seeks judgment against defendant in an amount in excess of $35,000. She is represented by Brandon Swartz and Anthony Giannetti of Swartz Culleton PC in Pittsburgh.
