MEDIA — A woman is suing a resort and spa, citing alleged failure to protect.
Jane Doe filed a complaint in the Delaware County Court of Common Pleas against AM Resorts LP, dba Secrets CAP Cana Resort and Spa, and Apple Vacations LLC, alleging the defendants breached their duty to protect guests from any dangerous situation while staying at their facility.
According to the complaint, in May 2018 the plaintiff was a guest of the defendants for an event held by her employer when she was allegedly sexually assaulted and raped by one of the defendants' employees.
After much delay in the investigation process of defendants, plaintiff claims she was taken to "Ministerio Publico" but was not comfortable with the psychologist provided to her. Plaintiff went to a private hospital and flew home the next day, accompanied by her sister, she says.
The plaintiff holds AM Resoirts LP, dba Secrets CAP Cana Resort and Spa, and Apple Vacations LLC responsible because the defendants allegedly failed to provide adequate security and failed to have adequate policies and procedures regarding the hiring of its employees to ensure they did not pose a risk of violence and/or sexual assault to guests.
The plaintiff requests a trial by jury and seeks judgment in a sum in excess of $50,000, plus interest, costs, and attorney's fees. She is represented by Michael van der Veen of Van der Veen, O'Neill, Hartshorn & Levin in Philadelphia.
