Landsville couple sue park owner for alleged negligence

LANCASTER — A Landsville couple are suing East Hempfield Township and Play By Design LLC, park controller and builder, citing alleged negligence.

Kristy L. Mack and Matthew J. Mack filed a complaint on Oct. 10 in the Lancaster County Court of Common Pleas against the defendants, alleging they failed to maintain the park's premises free of hazards.

According to the complaint, the plaintiffs allege that on June 10, 2017, Kristy Mack was an invitee at Amos Herr Park when she suffered a serious sprain to her left ankle due to an unsafe condition. She suffered a displaced right ankle fracture, fractures to her right tibia and fibula, and severe left ankle strain and contusions, the suit says. 

The plaintiffs hold East Hempfield Township and Play By Design LLC responsible because the defendants allegedly negligently designed and built the playscape structure with a step that was too high and exceeded the safe height for a step and failed to ensure that it was installed safely.

The plaintiffs request a trial by jury and seek judgment against defendants in an amount in excess of $50,000, interest and costs. They are represented by Edward Kennett of Katherman, Briggs & Greenberg in Lancaster.

The Lancaster County Court of Common Pleas Case No. is 18-8647.
