PHILADELPHIA — A man is suing Suntuf USA, Breyer GMBH, Breyer Extrusion Lines and others, citing alleged negligence.

Jose Muniz filed a complaint on Oct. 25 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging they negligently designed and manufactured a defective product.

According to the complaint, the plaintiff alleges that on Dec. 13, 2016, he was injured while using a cross cutting saw. He suffered serious injuries and incurred expenses for hospital and medical care and treatment. The plaintiff holds the defendants responsible because they allegedly failed to provide a cross-cutting saw that was reasonably fit, suitable or safe for their intended purposes.

The plaintiff requests a trial by jury and seeks damages that exceed the sum of $75,000, exclusive interest and costs. He is represented by Thomas Smith of Pellettieri, Rabstein & Altman in Princeton, New Jersey.

The U.S. District Court for the Eastern District of Pennsylvania Case No. is 5:18-cv-04619-JLS.
