Huntingdon Valley couple file suit over alleged slip at pool at Margaritaville-Grand Cayman

PHILADELPHIA — A Huntingdon Valley couple is suing Margaritaville Holdings LLC, d/b/a Margaritaville Beach Resort - Grand Cayman, et al, condominium owners, citing alleged negligence.

Carl Schmollinger and Gloria Schmollinger filed a complaint on Nov. 2 in the U.S. District Court for the Eastern District of Pennsylvania against the defendants, alleging  they failed to protect their guests from foreseeable harm.

According to the complaint, the plaintiffs allege that on March 4, Carl Schmollinger was walking on the walkway in the large pool area when he slipped and fell due to a slippery surface. He suffered serious and permanent injuries, including but not limited to a fractured right tibia and a fractured left femur, the suit says.

The plaintiffs hold Margaritaville Holdings LLC, d/b/a Margaritaville Beach Resort - Grand Cayman, et al, responsible because the defendants allegedly negligently failed to provide a safe walking area and failed to warn their guests of the existing danger.

The plaintiffs request a trial by jury and seek judgment against defendants in an amount exceeding $75,000, interest, costs, attorney's fees and all other relief that are appropriate. They are represented by James Golkow and Timothy Ryan of Golkow Hessel LLC in Philadelphia.

The U.S. District Court for the Eastern District of Pennsylvania Case No. is 2:18-cv-04741-NIQA.
