MEDIA — A law firm is suing a Wayne company, citing alleged breach of contract and unjust enrichment.
Marshall Dennehey Warner Coleman & Goggin filed a complaint the Delaware County Court of Common Pleas against Milestone Partners and David Proctor alleging the defendants breached their duty to pay plaintiff for legal fees despite demands.
According to the complaint, on April 19, 2017, after successfully representing defendants from a lawsuit, thereby relieving both Proctor and Milestone of any potential threat of liability, plaintiff alleges the law firm remains unreimbursed for its legal services amounting to $24,497.96 plus interest.
Plaintiff claims defendants benefited directly from their firm's aggressive pursuit of the Execution Proceedings and should be liable to pay for legal services they have received.
The plaintiff holds Milestone Partners and David Proctor responsible because the defendants allegedly failed and refused to pay plaintiff legal services, thus have been unjustly enriched to the detriment of plaintiff in the amount of $24,497.96.
The plaintiff requests a trial by jury and seeks judgment in the total sum of $24,497.96 plus interest, costs, disbursement of action and for any other relief the Court deems just and proper. They are represented by James Shay of Marshall Dennehey Warner Coleman & Goggin in Philadelphia.
