HARRISBURG - A business invitee is suing The Goodyear Tire and Rubber Co. and Goodyear Commercial Tire and Service Center No. 078, premises operators, citing alleged negligence.
Shane Amidon filed a complaint on Nov. 6 in the U.S. District Court for the Middle District of Pennsylvania against the defendants, alleging they failed to properly oversee employees and ensure they were not creating unsafe and/or hazardous condition.
According to the complaint, the plaintiff alleges that on April 5, 2017, he was at defendant's service center having a tire repair completed when an employee tossed a large tire and struck him in the back of his head, neck and back. He was caused to suffer mild traumatic brain injury, anxiety, post-traumatic stress disorder and left shoulder instability, the suit says.
The plaintiff holds Goodyear responsible because the defendants allegedly failed to adequately train and supervise their employees.
The plaintiff requests a trial by jury and seeks judgment against defendants in an amount in excess of $75,000, costs and interest. She is represented by Jaime Jackson of Atlee Hall LLP in Lancaster.
