Man loading truck holds food company, manufacturer liable for injury

PHILADELPHIA — A couple are suing Wakefern Food Corp., ShopRite Supermarkets Inc. and Americold Logistics LLC, owner of Hatfield Americol and manufacturer of a trailer truck, citing alleged negligence-premises liability/products liability and loss of consortium.

Brian Paluch and Marguerite Paluch filed a complaint on May 8 in the Court of Common Pleas for Philadelphia County against the defendants, alleging they failed to provide the plaintiff with a safe working environment. On Nov. 5, the defendants removed the case to Philadelphia federal court.

According to the complaint, the plaintiffs allege that on Dec. 26, 2017, Brian Paluch sustained various severe and permanent injuries when he was securing the straps to a truck trailer but its door fell on his hands while he was at Hatfield Americol. 

The plaintiffs hold Wakefern Food Corp., ShopRite Supermarkets Inc., and Americold Logistics LLC responsible because the defendants allegedly carelessly and negligently failed to inspect premises and recognize the defect that posed a dangerous condition.

The plaintiffs request a trial by jury and seek $50,000. They are represented by Brandon Swartz of Swartz Culleton PC in Newton.
