Property owners sue PECO Energy Co. in wake of fire

MEDIA — Property owners are suing a tenant and gas servicer of the property, citing alleged negligence.

Vincent and Rhonda D'Annunzio filed a complaint in Court of Common Pleas of Delaware County against Cheryl Diorsio and PECO Energy Co., alleging the defendants were negligence in using the property and maintenance of EPV causing the fire.

According to the complaint, on Nov. 15, 2016, Vincent and Rhonda D'Annunzio suffered a fire resulting in substation damages to their property at 2 Linda Lane in Aston. 

During the investigation, plaintiffs claim the fire started due to the disposal of smoking materials by tenant Diorsio. While the fire was still in progress and spreading, defendant PECO's excess flow valve associated with the services line at the Linda Lane failed to properly perform. As a result, the failure of the EPV fueled the fire and made extinguishment efforts more difficult and more hazardous, and ultimately ineffective. 

The plaintiffs holds defendants responsible because defendant PECO allegedly failed to install, test and/or maintain an EFV in the gas-provision facilities at the property.

The plaintiffs request a trial by jury and seek judgment for damages sustained in an amount in excess of $250,000, along with other relief the court deems equitable and just. They are represented by Brian Walker of Walker Group, PC in West Chester.
