Insurance company says man carelessly disposed of smoking materials

DOYLESTOWN — A subrogee is suing Robert Pacitti, an individual, claiming his property was negligently damaged by fire.

Erie Insurance Exchange, a/s/o Harshad Patel and Sajat Patel, filed a complaint on Nov. 19 in the Bucks County Court of Common Pleas against Robert Pacitti, alleging the individual failed to exercise due care in handling flammable materials.

According to the complaint, the plaintiff alleges that on April 30, 2017, at a property owned by Harshad and Sajat Patel at 1575 W. Street Road, Unit 726 in Westminster, substantial fire damage that originated from defendant's property was sustained. Plaintiff has become subrogated to certain claims from its insured. The plaintiff holds Robert Pacitti responsible because the defendant allegedly carelessly discarded smoking materials and failed to properly extinguish the same.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages in the amount of $37.079, plus costs and such other appropriate relief. It is represented by Richard Boyd Jr. of de Luca Levine LLC in Blue Bell.
