Independent contractor sues tank transport company for alleged negligence

PITTSBURGH — An independent contractor is suing M C Tank Transport Inc. and Lanxess Corp., worksite controllers, citing alleged unsafe work environment.

Adam Kotila filed a complaint on Nov. 21 in the Allegheny County Court of Common Pleas against the defendants, alleging they failed to provide a reasonably safe working condition.

According to the complaint, the plaintiff alleges that on April 3 he was a business invitee working at defendant's Lanxess location, loading bulk tank trucks when the pressurized probe propelled from the tanker into his face and head. 

He was allegedly caused to suffer serious and severe injuries including but not limited to face and head lacerations, orbital fractures, sinus injuries and visual and cognitive disorder. The plaintiff holds M C Tank Transport Inc. and Lanxess Corp. responsible because the defendants allegedly failed to have an organized safe job site plan, failed to properly train and supervise their employees, and failed to properly maintain the openings in its tanker.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount exceeding the jurisdictional limits of the court. He is represented by John Brown of Pittsburgh.

The Allegheny County Court of Common Pleas Case No. is 18-15200.
