PITTSBURGH — A patient is suing West Penn Allegheny Health System Inc., d/b/a Allegheny General Hospital, a health care provider, citing alleged negligence.

Kathleen Pozar filed a complaint on Nov. 23 in the Allegheny County Court of Common Pleas against West Penn Allegheny Health System Inc., d/b/a Allegheny General Hospital, alleging the health care provider failed to adhere to a physician's order that she was to go to the bathroom with assistance.

According to the complaint, the plaintiff alleges that on March 26 she underwent a right knee replacement surgery at defendant Allegheny General Hospital. As a result of defendant's alleged negligence, she was caused to fall while going to the bathroom. 

She allegedly suffered a complex right periprostetic distal femur fracture in multiple places. The plaintiff holds West Penn Allegheny Health System Inc., d/b/a Allegheny General Hospital, responsible because the defendant's nurse and nurse's aide allegedly failed to properly and adequately assist her.

The plaintiff requests a trial by jury and seeks damages in an amount exceeding the jurisdictional limits of the court. She is represented by Alan Perer of Swensen & Perer in Pittsburgh.
