PHILADELPHIA — A female student is suing Manor College, a higher education institution, citing alleged sex discrimination and retaliation.
Jane Doe filed a complaint on Dec. 10 in the U.S. District Court for the Eastern District of Pennsylvania against Manor College, alleging the higher education institution failed to act effectively on her report of sexual assault and her repeated pleas for assistance.
According to the complaint, the plaintiff alleges that on Sept. 17, 2016, she was sexually assaulted by two male students. She was able to record the incident and reported it to Manor College, the suit says.
Jane Doe was allegedly sanctioned for recording the students without their consent. From then on, Manor College began to monitor Doe’s every move and sanctioned her for a series of alleged student conduct violations. The complaint states she was given an unfair trial and was kicked out of the dormitory. Doe attempted suicide and was hospitalized.
The plaintiff holds Manor College responsible because the defendant's alleged deliberate indifference to Doe’s sexual assault deprived her of access to educational opportunities and benefits provided by the institution.
The plaintiff requests a trial by jury and seeks compensatory damages in amounts to be established at trial, injunctive relief, pre-judgment and post-judgment interests, court costs and expenses, including attorneys’ fees, and such other relief as the court deems fair and proper. She is represented by Scott Pollins of Pollins Law Firm in Swarthmore, and Linda Correia and Lauren Khouri of Correia & Puth LLC in Washington.
The U.S. District Court for the Eastern District of Pennsylvania Case No. is 2:18-cv-05309-GEKP.
