Black customer claims he was told to leave Just Wing It in Annville due to his race

SCRANTON — A customer is suing a restaurant, citing alleged racial discrimination.

Ricky Lee Bugg Jr. filed a complaint on Dec. 19 in the U.S. District Court for the Middle District of Pennsylvania against Just Wing It LLC for alleged violation of the Pennsylvania Human Relations Act.

According to the complaint, on Jan. 22, 2017, Bugg went into defendant's premises to get something to eat when he was allegedly confronted by defendant's owner and an employee and was told that he must pay first before being provided with his food order. 

After exchanging words with Christopher Behney, the owner of the restaurant, plaintiff then was asked to leave the restaurant but refused to give him back his money despite request, the suit says. Plaintiff claims the aggressive behavior of defendant was because of his race, causing him humiliation and inconvenience. 

The plaintiff holds Just Wing It LLC responsible because the defendant allegedly created such an aggressive and racist environment that plaintiff was unable to complete his transaction and obtain food from the restaurant.

The plaintiff requests a trial by jury and seeks injunctive and declaratory relief, compensatory damages, together with interest, attorney's fees, costs, and any other relief the court may deem just and proper. He is represented by Michael Kelley of Smigel, Anderson & Sacks in Harrisburg.
