PITTSBURGH — A commercial driver is suing Malone Bussing Services, Steve Malone and Teresa Darden, tour bus operators, citing alleged negligence.
Larry Whetstone filed a complaint on Dec. 19 in the Allegheny County Court of Common Pleas against Malone Bussing Services, Malone and Darden alleging the defendants negligently entrusted their tour bus to defendant Darden.
According to the complaint, the plaintiff alleges that on April 27, 2018, he was severely injured when defendant's tour bus struck the tractor-trailer he was operating on the Pennsylvania Turnpike in Monroeville.
Due to the severity of his injuries, he says he will never be able to drive a tractor trailer again. The plaintiff holds Malone Bussing Services, Malone and Darden responsible because defendant Darden failed to properly observe the roadway and operate the tour bus without due regard for the rights, safety and position of plaintiff's tractor trailer.
The plaintiff requests a trial by jury and seeks actual and punitive damages, with interest, costs and such other just and proper relief. He is represented by Brian Benestad of HKM Employment Attorneys in Pittsburgh.
