MEDIA — A legal service provider has settled its case with Thaddeus and Carmel Kremser, husband and wife, citing alleged breach of contract, breach of duty, and unjust enrichment.
Reidenbach & Associates LLC initially filed a complaint on Jan. 15, 2019 in the Delaware County Court of Common Pleas against the defendants, alleging they failed to pay all amounts owed to plaintiff in a timely manner.
According to the complaint, the plaintiff alleged that between Nov. 21, 2014 and March 19, 2015 it performed legal works in favor of defendants, all authorized and requested by defendants. As a result of defendants' breach, plaintiff suffered loss for the unpaid legal services in the amount of $5,341, plus collection costs of $2,734, the suit said.
The plaintiff initially held Thaddeus and Carmel Kremser responsible because despite accepting and appreciating the benefits of plaintiff's legal services, the defendants allegedly failed to pay.
On Aug. 19, 2020, counsel for the plaintiff filed a praecipe to mark the instant case as settled, discontinued and ended, with prejudice. Terms of the settlement were not disclosed.
Prior to settlement, the plaintiff requested a trial by jury and seeks judgment against defendants in an amount of $8,075, plus costs, fees, expenses and such other just and reasonable relief. It is represented by Brian Marriott and Kaitlyn T. Sears of Reidenbach & Associates, in Wayne.
