Lawsuit: Burst pipe causes man to be electrocuted at Pennsylvania Hospital

PHILADELPHIA – A new lawsuit filed in state court alleges a Philadelphia man was electrocuted at Pennsylvania Hospital, when a pipe suddenly burst and water was caused to spill from the wall.

Gar Bezotsky Jr. of Philadelphia filed suit in the Philadelphia County Court of Common Pleas on Dec. 21 versus L.F. Driscoll Company, LLC of Bala Cynwyd, Burns Mechanical System of Philadelphia, Burns Mechanical, Inc. of Horsham, Heartwood Building Group of King of Prussia and Independence Electric, Inc., also of Philadelphia.

“On or about Oct. 17, 2016, plaintiff Bezotsky was lawfully in the Pennsylvania Hospital Labor and Delivery Unit of defendants located at 800 Spruce Street in Philadelphia, when suddenly and without warning, a pipe burst, causing water to spill from the wall, resulting in plaintiff being electrocuted due to the negligence of defendants’ employees causing him to suffer serious, painful and grievous injuries,” according to the lawsuit.

The sole cause of the accident was the negligence of the defendants, the plaintiff says, due to its failing to install the pipe properly, failure to correct or repair the pipe and allowing a defective condition to exist, among numerous other failures. As a result, the plaintiff suffered serious full-body injuries, but especially to his right arm and right hand, dizziness and internal injuries, aches, pains, mental anxiety and anguish.

For negligence, the plaintiff is seeking compensatory and punitive damages in excess of $50,000, jointly and severally, plus pre-judgment interest, costs and other and relief as the court may deem appropriate.

The plaintiff is represented by Sean M. Fulmer of Schatz & Steinberg, in Philadelphia.

The defendants are represented by Michelle D. Coburn of White & Williams and Andrew J. Keenan of the Law Office of Donna M. DiPietro, both also in Philadelphia.
