Wexford Health Sources is named in Erie lawsuit alleging inmate suffered wrongful death

ERIE — The sister of a deceased inmate is suing Wexford Health Sources Inc.; Medical Associates of Erie; Gary Peterson, DO; and Christina Mealy PA-C, citing alleged wrongful death, violation of the Eighth Amendment and survival action.

Amber Corritore filed a complaint on Jan. 22 in the U.S. District Court for the Western District of Pennsylvania against the defendants, alleging they failed to properly conform to accepted standards of medical practice and care in the diagnosis, treatment and medical management of April Corritore.

According to the complaint, the plaintiff alleges that between Sept. 17, 2018, and Oct. 20, 2018, April Corritore was diagnosed with pneumonia and cellulitis and was prescribed two different antibiotics to treat her infections. She was processed into the Erie County Prison two days later, the suit says. 

The antibiotics were not ordered for April Corritore by anyone at the Erie County Prison, the suit says. April Corritore begged daily for assistance from the medical staff, but her condition continued to deteriorate until Oct. 19, when she died, the suit says.

The plaintiff says the defendants were negligent and deliberately indifferent to April Corritore’s serious medical need because they failed and refused, for non-medical reasons, to create and implement an updated medical plan.

The plaintiff requests a trial by jury and seeks an amount in excess of $75,000, plus attorney's fees, and all other relief allowed by law. She is represented by John Mizner and Joseph Caulfield of Mizner Law Firm in Erie.
