PHILADELPHIA – A Philadelphia cyclist is charging two road excavation companies with negligence, after an uneven patch of road allegedly led him to crash his bicycle and suffer both a broken arm and other disabling injuries.
Greg Mazur of Philadelphia filed suit in the Philadelphia County Court of Common Pleas on Nov. 30 versus Wampole-Miller, Inc. (doing business as “Miller Brothers Div. of Wampole-Miller, Inc.”) of Conshohocken and DePaul & Company, Inc. of King of Prussia.
On or about Jan. 19, 2017, the suit explains plaintiff Greg Mazur was bicycling on the 3100 block of Market Street – an area where the defendants were alleged to have previously conducted excavation work and failed to abide by applicable law governing such activities.
“While plaintiff was riding along, plaintiff’s bicycle wheel came into contact with ‘the defect’ a depression and excavated/settled unlevel condition in the ground surface of the street which was a dangerous and defective condition in the street which caused plaintiff to crash and suffer serious and permanent injuries,” the lawsuit states.
Mazur argues the defendant companies’ negligence was the proximate cause of his accident and injuries.
For a count of negligence, the plaintiff is seeking damages, jointly and severally, in excess of $50,000, plus interest and costs.
The plaintiff is represented by Stuart Leon of Stuart Leon, P.C., in Philadelphia.
The defendants are represented by Andrew J. Connolly and Matthew D. Johnson of Post & Schell, also in Philadelphia.
