Farmers Fire Insurance seeks declaratory relief regarding assault suit filed against Pittsburgh bar

PITTSBURGH – An insurance company is seeking a declaration that it no longer has a duty to provide coverage to a Pittsburgh business for a lawsuit.

The Farmers Fire Insurance Co. filed a complaint for declaratory judgment in the Allegheny County Court of Common Pleas against Park Valley Lounge Inc., Joseph Jouver, Leanne Gessler and Adam Jacob Brown.

According to the complaint, the plaintiff issued a commercial fire policy to Jouver and Park Valley Lounge. In December 2018, the suit states Gessler filed a complaint, claiming that in July 2016, Brown forcefully grabbed Gessler, lifted her and dropped her to the ground at Park Valley Lounge, causing her injury.

The plaintiff alleges it provided defense to Park Valley Lounge and seeks a declaration that it does not have a duty to continue to defend it with respect to Gessler's assault and battery claims, including an award, verdict, judgment or settlement. 

The plaintiff is seeking a declaration established that no liability coverage is provided for a continued defense and/or indemnification, attorney fees and court costs. The plaintiff is represented by Jennifer A. Artman of Andracki, Sysak & Artman P.C. in Pittsburgh.
