Couple file suit against Penske Truck alleging that a spring broke and caused a door to fall on the husband

PITTSBURGH – A Hopwood couple have filed suit against the owners of a refrigerated delivery truck after the husband allegedly sustained a torn rotator cuff caused by a falling overhead door.

John J. Janosek and Laura Janosek filed a complaint May 10 in the Allegheny County Court of Common Pleas against Penske Truck Leasing Co. LP and PTL GP LLC alleging negligence.

According to the complaint, on May 30, 2018, John J. Janosek was employed by Perry's Ice Cream and was operating a refrigerated delivery truck provided by the defendants to his employer. The suit states the plaintiff was making a delivery and pulled down the strap on the overhead door of the truck with the spring cable snapped and the overhead door fell on the plaintiff's right shoulder, right elbow and back. 

The suit states the plaintiff was sustained a torn rotator cuff and other injuries as a result.

The suit states the same spring cable broke on the truck a few weeks earlier and the defendants repaired it.

The plaintiffs are seeking all reasonable sums due, attorney fees and court costs. They are represented by Thomas E. Crenney and Alicia R. Nocera of Thomas E. Crenney & Associates LLC in Sewickley.
