PITTSBURGH – A local construction company has settled litigation with one of its clients, centered on damage incurred at properties when removing garage that led to legal action from the homeowners’ insurance company.
On Dec. 19, counsel for plaintiff State Farm Fire & Casualty Co. filed a praecipe to mark the instant matter between it and Reynolds Brothers, Inc. settled, discontinued and ended. No disclosure of settlement terms was made.
State Farm Fire & Casualty Co. of Bloomington, Illinois, (for administrative services only, representing Scott and Julie Yacoviello of Pittsburgh) first filed suit in the Allegheny County Court of Common Pleas on Dec. 28, 2017 versus Reynolds Brothers Inc. of Burgettstown.
“On or about April 14, 2017, during the removal of the subject property’s attached garage, said property was damaged," the suit stated. "This caused extensive damage to subrogors’ real and personal property, as well as the imposition of other expenses and hardships besides. Thus, as a result of the negligent and/or otherwise unlawful action and/or inaction of defendant, subrogors suffered damage to their property, as well as the imposition of additional expenses and hardship besides, in an amount in excess of $50,000.” .
The plaintiff alleged the defendants failed to exercise reasonable care of its duties at the subject property by not removing the attached garage safely, failing to warn subrogors and others of the dangers associated with same and violating the standards of care in both laws and industry practices applicable to this action.
Prior to settlement and for counts of negligence, breach of contract and breach of implied warranties, the plaintiff was seeking damages in excess of $50,000, plus costs, interests and any other equitable and just relief.

The defendant was represented by S. Manoj Jegasothy and Jessica G. Lucas of Gordon & Rees in Pittsburgh.
