Suggestion of bankruptcy filing is withdrawn against Pioneer Mechanical from breach of contract lawsuit

PITTSBURGH – Per docket records in the Allegheny County Court of Common Pleas, a presumption of bankruptcy regarding one of the defendants in a litigation between an electrical company plaintiff and construction companies has been withdrawn.

On June 17, counsel for plaintiff Consolidated Electrical Distributors, Inc. filed a praecipe to withdraw a suggestion of bankruptcy for Pioneer Mechanical Services, LLC, which had originally been submitted on March 19.

Consolidated Electrical Distributors, Inc. of Pittsburgh filed suit in the Allegheny County Court of Common Pleas on Dec. 26, 2017 versus Pioneer Mechanical Services, LLC of Coraopolis, Joseph M. Ravas of Moon Township and HGC Construction Co., of Cincinnati.

HGC was the general contractor on a construction project known as Artis Senior Living of South Hills, in Bethel Park. Per a subsequent credit application, plaintiff sold and delivered certain goods and merchandise to defendant Pioneer which supposedly went unpaid for, leading to an outstanding total balance of $107,921.59 – comprised of a principal balance of $83,152.04, service charges of $24,769.55 through Dec. 20, 2017 and attorney’s fees of $2,079, for a grand total of $110,000.59, the suit says.

Further, violation of a joint check agreement allegedly occurred and resulted in an outstanding total balance of $81,053.08 – comprised of a principal balance of $77,123.10, penalty charges of $925.49 to Dec. 21, 2017 and attorney’s fees of $2,079, for a grand total of $81,053.08.

For counts of breach of contract against Pioneer, breach of personal guaranty agreement against Ravas and breach of joint check agreement against HGC and Pioneer, the plaintiff is seeking damages of $110,000.59 along with continuing contractual service charges of 1.5 percent per month thereon from and after Dec. 21, 2017 and continuing attorney’s fees as they accrue in this matter against Pioneer and Ravas, and jointly and severally in the amount of $81,053.08, with continuing interest thereon at the rate of 1 percent per month, continuing penalty thereon at the rate of 1 percent per month, accrued attorney’s fees and record court costs against HGC Construction Co. and Pioneer.

The plaintiff is represented by Nicholas D. Krawec of Bernstein-Burkley, in Pittsburgh.

The defendants are represented by Kara S. Eaton and Kevin L. Barley of Crown Castle, plus Wayne M. Chiurazzi of Chiurazzi Law Group, all also in Pittsburgh.
