Lawsuit: Dance floor mishap the fault of the band

PHILADELPHIA — A couple are suing a band, alleging one of the members caused the wife to break her arm.

Mary Lynn Bonsall and Steven Asbath filed a complaint on July 10 in the U.S. District Court for the Eastern District of Pennsylvania against The Infernos Band LLC.

According to the complaint, the plaintiff is seeking damages for an incident that took place on Dec. 31 when the plaintiff was at Saucon Valley Country Club. The plaintiff was invited to go on the dance floor and while Bonsall and Asbath were situating themselves on the dance floor, a member of the defendant's band allegedly backed up into the plaintiff, throwing her to the floor. 

The plaintiff's left arm was fractured in three places due to the fall, the suit says.

The defendant is accused of negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Phillip Hof and Jill Kelly McComsey of Hof & Reid LLC.
