Sears sued over fingers lost on a table saw

PHILADELPHIA – A couple's lawsuit against Sears over a table saw that allegedly collapsed and severed two fingers has been removed to the U.S. District Court for the Eastern District of Pennsylvania.

Geoff and Stacie Hess filed a complaint on July 9 against Sears Holding LLC, Sears Roebuck & Co. and Sears Holding Corporation in the Court of Common Pleas of Philadelphia County.

According to the complaint, Geoff Hess lost two fingers from his right hand when a 10-inch portable table saw he bought at Sears collapsed.

Sears was incorporated in Delaware and maintains its principal business in New York. Further, the amount of the liability at stake exceeds the $50,000 Philadelphia County compulsory limit, thus creating diversity jurisdiction, the removal notice says.

The Hesses allege product liability and seek all reasonable sums due, attorney fees and court costs.
