Man who fell at Garnet Valley School District administration building files suit seeking more than $50,000

MEDIA – A Springfield man who allegedly fell and was injured on a stairway at a Glen Mills school district administration building is suing the district, claiming negligence. 

According to the Sept. 25 Court of Common Pleas for Delaware County filing, plaintiff Thomas Mahoney filed a complaint against defendant Garnet Valley School District.

In November of 2017, Mahoney alleges he was at the school district's administration building when he fell on what he claims were defective steps and/or stairway. Mahoney alleges in his suit that the school district was negligent for permitting dangerous conditions to exist.

"The accident was caused exclusively and solely by the defendant's negligence," Mahoney states in his suit.  

He also claims the school district "failed to give warning of the dangerous condition" or "erect barricades or to take any other precautions to prevent injury to plaintiff."

"Defendant through their employees, servants and agents, either had actual notice of the unsafe and dangerous condition of the premises and sufficient time to correct the dangerous situation, or the condition existed for so long a period of time prior to the occurrence that defendants, in the exercise of due care, could and should have known of the unsafe and dangerous condition of the premises," Mahoney alleges in the complaint. 

Mahoney seeks more than $50,000 in damages for his "permanent disability and a permanent impairment of his earning power and capacity," the suit states.

The plaintiff is represented by Thomas Sacchetta of Sacchetta & Baldino in Media.
