Stout's Charter Service faces lawsuit after passenger's finger allegedly gets caught on railing

PHILADELPHIA – A New Jersey-based charter company is facing a negligence lawsuit by an Ardmore woman who allegedly fell while exiting a bus last year.

According to the Philadelphia Court of Common Pleas filing, Kathleen McGinley filed suit against Stout's Charter Service Inc. alleging negligence. 

McGinley alleges on June 6, 2018, she was a passenger on a motor coach bus owned by the defendant. She alleges as she was exiting the bus, her finger got caught on a clamp or metal piece on the railing and caused her to fall.

"As a direct and proximate result of the negligence of the defendant, plaintiff was caused to fall and suffer serious and permanent injuries, including, but not limited to: closed displaced fracture of the proximal phalanx of the left finger and contracture, unspecified joint, all to her great detriment and loss, financial and otherwise," McGinley states in her suit. 

McGinley seeks damages of more than $50,000 plus litigation costs. She is represented by Michael van der Veen of Van der Veen, O'Neil, Hartshorn & Levin in Philadelphia. 

The case was transferred to the U.S. District Court for the Eastern District of Pennsylvania on Oct. 16.
