Parents allege kindergartner was sexually assaulted by classmate at Sunbury elementary school

WILLIAMSPORT – The Shikellamy School District is facing a suit filed by parents who claim their child was sexually assaulted by another student while he was in kindergarten. 

M.W., a minor, and his parents filed a complaint in the Court of Common Pleas of Northumberland County against Shikellamy School District alleging violation of Title IX. 

The case was removed to the U.S. District Court for the Middle District of Pennsylvania on Jan. 6.

The suit states M.W. was a kindergarten student at Beck Elementary School in Sunbury for the 2016-2017 academic year. The plaintiffs allege that in the late spring of 2016, M.W. was "sexually accosted" by another student during gym class when the other student pulled down M.W.'s pants and licked his penis. 

The plaintiffs allege the students had no adult supervision during the glass and that the school failed to take corrective action. The plaintiffs also allege sexual harassment of M.W. had been ongoing for some time.

The plaintiffs seek monetary relief of more than $50,000, a trial by jury and all other appropriate relief. They are represented by James Best in Sunbury.
