City of Chester faces suit from county agency over allegations of noncompliance of Right-to-Know Law

MEDIA – The city of Chester is facing a lawsuit filed by the Chester County Water Authority alleging the city's noncompliance of Pennsylvania's Right-to-Know Law (RTKL).

Chester County Water Authority filed a complaint Jan. 13 in the Court of Common Pleas of Delaware County against the city.

The Chester County Water Authority alleges the city has failed to comply with the requirements of the RTKL. According to the suit, the city failed to comply with the Chester County Water Authority's request made by its outside counsel on Sept. 27, 2019. 

The suit states the request sought all documents concerning the city's RTKL policies, its current home rule charter and other documents.

The plaintiff alleges the city, which was found by the Office of Open Records to have acted in bad faith regarding the request in November 2019, is engaging in an "ongoing campaign to ignore the simple, straightforward and mandatory requirements" of the RTKL. 

The Chester County Water Authority seeks a civil penalty against the defendant, monetary relief and all other just relief. It is represented by Kevin Kent, Joseph Jesiolowski, Megan Guernsey and Andrew Garden of Conrad O'Brien PC in Philadelphia.
