Veteran takes legal action against 3M Company for allegedly manufacturing faulty earplugs

PHILADEPHIA – A military veteran has launched a legal battle with a handful of technology companies, accusing them of selling hazardous combat earplugs during his deployment in Iraq.

The defendants in Christopher Sammacicci’s lawsuit are 3M Company, 3M Occputational Safety LLC, Aearo Holding LLC, Aearo Intermediate LLC, Aearo LLC, and Aearo Technologies LLC. The lawsuit was filed in the U.S. District Court for the Eastern District of Pennsylvania Feb. 25.

“For over a decade, 3M sold the military defective and unsafe earplugs for use by Mr. Sammacicci and others, exposing our military service members to injuries and increased risks on the battlefield,” according the lawsuit. 

It also alleges that 3M was aware that the earplugs didn’t measure up to safety measures. Sammacicci said because of the defendants’ alleged conduct, he’s suffered embarrassment, humiliation, mental anguish, and other experiences.

Sammacicci is suing for past and future pain and suffering, wage loss, medical expenses, loss of enjoyment of life, mental anguish and distress, disfigurement, and physical impairment. He’s also suing for loss of earnings and loss of earning capacity, as well as attorney’s fees and related court costs, along with punitive or exemplary damages to later be determined at trial.
