Faegre Drinker Biddle & Reath LLP recently issued the following announcement.

Partners Laura Phillips and Mike Daly are speaking on “Unfinished Business with the TCPA” for a CLE webinar of the Federal Communications Bar Association (FCBA) on Tuesday, April 21, 2020. Laura is moderating the panel, which includes Mike as well as counsel of the United States Telecom Association (USTelecom) and ACA International, and the deputy bureau chief of the FCC Consumer and Governmental Affairs Bureau.

Even before the passage of the Telephone Robocall Abuse Criminal Enforcement and Deterrence Act (TRACED Act), the FCC had before it a range of critical Telephone Consumer Protection Act (TCPA) interpretation questions and issues. These included, in light of varied court opinions, the very consequential question of what is an automatic telephone dialing system (ATDS), as well as a range of questions about consent, revocation and exception/exemption conditions. Additionally, the FCC was in the midst of implementing its determination to stand up a reassigned number database.

Mike and Laura will examine the range of issues the FCC is considering or implementing, and where they might leave legitimate businesses and other callers seeking clarity and reasonable safe-harbors.
