PHILADELPHIA – A West Chester company says a business development company says a former employee is using its trade secrets at that company.
PrimePay sued GetBeyond, of New Jersey, and Peter Cappiello on Sept. 4 in U.S. District Court for the Eastern District of Pennsylvania. Cappiello was the former senior vice president of PrimePay who had a non-disclosure and intellectual property agreement and developed and sold payroll services to clients, the suit says.
But since his employment was terminated in November 2019, he’s been using PrimePay’s info at his new place of work, the suit says. He started at GetBeyond days after leaving PrimePay and was hired to create a payroll system that directly competes with PrimePay’s the suit says.
“In March 2020, PrimePay learned for the first time that prior to Cappiello’s departure from PrimePay, he downloaded PrimePay files containing confidential and proprietary information and trade secrets… onto his personal hard drive,” the suit says.
“PrimePay later discovered that the Stolen Proprietary Information stored on the Hard Drive contained over twenty thousand (20,000) PrimePay documents.”
