City of Clairton refusing to pay contractors for roadwork project, suit says

PITTSBURGH - The City of Clairton, along with its engineering firm, KLH Engineers, Inc, is facing charges in the Allegheny County Court of Common Pleas from a general contractor who says the city is refusing to pay costs owed for a roadwork project.

According to a February complaint, Independent Enterprises, Inc, was hired by Clairton to mill and resurface certain city roads. Independent Enterprises entered a contract with Clairton for the project with terms to pay a total of $625,515.60 in payment plans. 

The contractors reportedly encountered situations that added expenses to the project, and presented the claims and requests for payment to the city. The contractor successfully completed the project without payment being made by the city. 

Clairton is refusing to pay the additional amounts requested, according to the suit. 

The contractor is suing for one count of breach of contract, one count of breach of warranty, one count of quantum meruit/unjust enrichment, and count of breach of prompt payment act and one count of negligent misrepresentation. Each count demands restitution over $35,000. 

Independent Enterprises is represented by Summers, McDonnell, Hudock, Guthrie and Rauch, PC, of Pittsburgh.
