Worker with epoxy allergy sues construction companies over reaction

PITTSBURGH - A Pittsburgh man called S &S Solid Surface Fabrications and Cummings Construction into civil court after the contractors allegedly let him suffer an allergic reaction at a job site.

According to documents filed March 20 in the Allegheny County Court of Common Pleas, plaintiff David Wetmore worked for the subcontractor Bill Hudic Contracting. Through his employer, Wetmore was working at a job site on Highmont Road in Pittsburgh, where the defendants were also contracted. 

Wetmore says he suffers from a severe allergy to epoxy, and began informing multiple employees of the defendants that he needed them to let him know beforehand when they were going to work with epoxy so he could avoid the job site.

The suit says despite having more than enough notice of the plaintiff's request, the defendants used epoxy at the site on April 11, 2019, unknown to plaintiff until the fumes emanated into his room and caused a severe allergic reaction. According to the suit, Wetmore's injuries included chemical pneumonitis, bronchial inflammation and paradoxical vocal cord dysfunction. 

The defendants are charged with respondeat superior and negligent hiring, supervision and retention.

The plaintiff is represented by Kontos Mengine Killion and Hassen of Pittsburgh.
