Stroke victim suing Mercy Catholic Medical for alleged negligence during emergency room visit

MEDIA - A New Castle couple are suing Mercy Catholic Medical Center, doctors and staff alleging negligence during a July 2019 emergency room visit and alleged failure to diagnose symptoms of a stroke.

The suit was filed April 8 by attorney Andrew R. Spirt on behalf of plaintiffs Damon and Sallie Jones in the Court of Common Pleas of Delaware County.

The suit alleges that on July 19, 2019, Damon Jones was transported by ambulance to Mercy Catholic Medical Center from an urgent care facility due to concerns that his symptoms – extremely elevated blood pressure, facial droop and other unnamed neurological symptoms – combined with his health histories made him a possible candidate for a stroke. The suit also alleges the ambulance crew called in an ALS alert to the hospital in response to the belief he was possibly suffering symptoms of a stroke.

Despite his symptoms and continued elevated blood pressure following administration of blood pressure medications, the suit alleges that Jones was only kept in the hospital for several hours, the assigned physicians failed to order tests, and he was discharged without admittance with his blood pressure still elevated.

The following day, following a flight to Florida, the suit alleges Jones was admitted to a Miami hospital with stroke symptoms and diagnosed with an ischemic stroke. The suit also alleges Jones has since lost use of extremities on one side and neurological impairments.

The Joneses are seeking a judgement in excess of $50,000, according to court documents.
